DECISION & ORDER ON MOTION

2012-883 Q CR
The People of the State of New York, Plaintiff, v
Keith Reid, Defendant.

Motion by defendant for leave to prosecute an appeal from an order of the Criminal Court of the City of New York, Queens County, dated March 6, 2012, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied as academic, as defendant's motion for leave to reargue his prior application for a certificate granting leave to appeal has been denied and, thus, there is no appeal pending.
