| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to enjoin the respondent and others acting on his behalf, including the Sheriff of Suffolk County, from evicting her from the former marital residence, pending hearing and determination of an appeal from an order of the Supreme Court, Suffolk County, dated July 15, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the appellant's time to vacate the former marital residence in accordance with the order of the Supreme Court, Suffolk County, dated July 15, 2013, which was, in effect, tolled by the temporary restraining order contained in the order to show cause of this Court dated August 21, 2013, is extended until October 16, 2013.
