(Docket No. N-1147/07)

DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to serve and file a pro se supplemental brief on an appeal from an order of the Family Court, Kings County, dated May 10, 2011, and, in effect, for leave for the appellant's assigned counsel to prepare the brief on behalf of the appellant.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, so much of the decision and order on motion of this Court dated December 13, 2012, as granted leave to file a pro se supplemental brief is recalled and vacated, as the appellant has failed to file a supplemental pro se brief although afforded sufficient opportunity to do so.

SKELOS, J.P., COHEN, MILLER and HINDS-RADIX, JJ., concur.
