| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Family Court, Queens County, dated August 20, 2013, pending hearing and determination of an appeal therefrom, for an expedited briefing schedule, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order dated August 20, 2013, is denied; and it is further,
ORDERED that the branch of the motion which is for an expedited briefing schedule is granted to the extent that a scheduling order will be issued pursuant to 22 NYCRR 670.4(a), and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see Family Ct Act § 1112[a]).
