It is Ordered that respondent's motion is granted without opposition, only to the extent of dismissing the appeal. That portion of respondent's motion that seeks the release of funds is denied without prejudice to respondent renewing said motion and presenting proof that defendant-appellant did in fact deposit monies with Finance Administrator of the City of New York in connection with this case.
