It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that defendants-appellants' motion is granted on condition that defendants-
appellants perfect their appeals by no later than the December 2013 term - the filing deadline is October 9, 2013. In the event of defendants-appellants' failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the appeals and renewing its application for sanctions. Plaintiff-respondent's cross-motion is denied in its entirety.
