It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that defendants-appellants' motion is granted on condition that defendants-appellants perfect their appeal by no later than the January 2014 term - the filing deadline is November 6, 2013. In the event of defendants-appellants' failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the appeal.
