Motion by the respondent, inter alia, to strike the appellant's supplemental appendix on an appeal from a judgment of the Supreme Court, Nassau County, dated April 20, 2013, and to dismiss the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until October 21, 2013, and the respondent's brief shall be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted.
