DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Supreme Court, Nassau County, entered December 11, 2012, and the proposed arbitration between the parties identified by American Arbitration Association file number 13 180 1621 12, pending hearing and determination of an appeal from the order. Separate motion by the appellant, inter alia, to enlarge the record on appeal to include certain documents or for the Court to take judicial notice of those documents.

Upon the papers filed in support of the motion for a stay and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion, inter alia, to enlarge the record on appeal to include certain documents or for the Court to take judicial notice of those documents and the papers filed in opposition thereto, it is

ORDERED that the motion for a stay is granted to the extent that the proposed arbitration between the parties identified by American Arbitration Association file number 13 180 1621 12 is stayed pending hearing and determination of the appeal and that motion is otherwise denied; and it is further,

ORDERED that the motion, inter alia, to enlarge the record on appeal to include certain documents or for the Court to take judicial notice of those documents is denied.
