Motion by the appellant, in effect, for summary reversal of an order of the Supreme Court, Kings County, dated October 5, 2012, on the ground that the respondent failed to timely serve and file a brief. Cross motion by the respondent to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is granted, the respondent's time to serve and file a brief is enlarged, and the respondent's brief submitted to the Clerk of the Court is accepted for filing and deemed timely served.
