DECISION & ORDER ON MOTION

Appeal by Christian G. Sampson and the Town of Ramapo from an order of the Supreme Court, Rockland County, dated June 18, 2013. By order to show cause dated July 30, 2013, the parties or their attorneys were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceedings on the ground that the order is not appealable as of right and leave to appeal has not been granted. Motion by the appellants for leave to appeal to this Court from the order dated June 18, 2013.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the appellants' motion and the papers filed in opposition thereto, it is

ORDERED that the appellants' motion is granted; and it is further,

ORDERED that the motion to dismiss the appeal is denied.
