2013-02282 DECISION & ORDER ON MOTION Robert Rosenthal, respondent, v Lora A. Rosenthal, appellant. (Index No. 26245/10)

Motion by the appellant for leave to prosecute an appeal from a judgment of the Supreme Court, Suffolk County, entered December 31, 2012, as a poor person and to waive the certification requirements of 22 NYCRR 670.10.2(f).
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to prosecute the appeal as a poor person is denied; and it is further,
ORDERED that the branch of the motion which is to waive the certification requirements of 22 NYCRR 670.10.2(f) is denied with leave to renew when the appeal is perfected; and it is further,
ORDERED that on the Court's own motion, the appellants' time to perfect the appeal is enlarged until December 10, 2013, and the record or appendix on the appeal and the appellants' brief must be served and filed on or before that date.
