DECISION & ORDER ON MOTION

Motion by Richard J. Zimmerman for reargument and reconsideration of an opinion and order of this Court dated March 27, 2013, which suspended him from the practice of law for a period of two years, effective April 26, 2013, and, upon reargument or reconsideration, to reduce the sanction to a lesser term.

Mr. Zimmerman was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 30, 1997. By decision and order on application of this Court dated March 31, 2011, as amended April 26, 2011, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against Mr. Zimmerman and the issues raised were referred to Honorable Stella Schindler, as Special Referee, to hear and report. By decision and order on application of this Court dated June 27, 2011, inter alia, the Grievance Committee was granted leave to serve a supplemental petition containing additional charges. By opinion and order of this Court dated March 27, 2013, Mr. Zimmerman was suspended from the practice of law for a period of two years, effective April 26, 2013, based on eight charges of professional misconduct.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
