Application by defendant for a writ of error coram nobis seeking leave to file a late notice of appeal from a judgment of conviction of the District Court of Suffolk, First District, rendered April 9, 2012.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted (see People v Syville, 15 NY3d 391 [2010]); and it is further,
ORDERED that the papers submitted in support of the application are deemed to constitute a timely notice of appeal; and it is further,
ORDERED that the appeal shall be perfected by January 3, 2014; and it is further,
ORDERED that defendant's counsel is directed to serve a copy of this decision and order upon the clerk of the court from which the appeal is taken.
