Appellant having moved for an extension of time to perfect the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Oswego on March 4, 2013, and
Respondent Hector B. Santana having cross-moved to dismiss for failure to perfect timely the appeal taken from the order entered March 4, 2013,
Now, upon reading and filing the affidavit of Joseph S. Cote, III, Esq., sworn to September 6, 2013, the affidavit of Laurence F. Sovik, Esq., sworn to September 11, 2013, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal is granted to the extent that the ordering paragraph of the order of this Court entered July 2, 2013, is hereby amended by deleting the date September 3, 2013, and inserting in its place the date November 4, 2013, and
It is further ORDERED that the cross motion is dismissed.
