Andrew James Mayo, appellant, et al.,

plaintiff, v State of New York, respondent.

(Claim No. 115475)

DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute appeals from a decision of the Court of Claims dated May 9, 2012, a judgment of the same court dated July 5, 2012, and an order of the same court dated March 11, 2013, as a poor person.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal from the decision (Appellate Division Docket No. 2013-07643) is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509), and the appellant's time to perfect the remaining appeals is enlarged until November 6, 2013; and it is further,

ORDERED that the motion is denied.

ANGIOLILLO, J.P., HALL, AUSTIN and MILLER, JJ., concur.
