Motion by the appellant Jan Gilbert on an appeal from a judgment of the Supreme Court, Kings County, rendered February 28, 2012, on which appeal he was granted leave to adopt the joint brief and appendix filed by his codefendants on related appeals from five judgments of the same court rendered April 4, 2012, and three judgments of the same court rendered April 5, 2013, in effect, for leave to allow Borstein & Sheinbaum to appear for him as counsel at oral argument and adopt the joint brief filed on behalf of the other appellants, and to direct the other appellants to file a supplemental appendix containing certain documents.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, for leave to allow Borstein & Sheinbaum to appear for him as counsel at oral argument and adopt the brief filed on behalf of the other appellants is granted; and it is further,
ORDERED that the branch of the motion which is to direct the other appellants to file a supplemental appendix containing certain documents is granted to the extent that on or before October 18, 2013, the appellant Jan Gilbert may serve and file a supplemental appendix containing relevant papers or rely upon the material contained in the original papers filed with the Court, and that branch of the motion is otherwise denied; and it is further,
ORDERED that on the Court's own motion, so much of the decision and order on motion of this Court dated May 28, 2013, as directed the appellant Jan Gilbert to file a waiver of right to appellate counsel is recalled and vacated; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief in connection with the appeal by the appellant Jan Gilbert is enlarged until November 18, 2013, and the respondent's brief must be served and filed on or before that date.
