Motion by the petitioner New York State Division of Human Rights for leave to reargue stated portions of a proceeding pursuant to Executive Law § 298 which was determined by decision and judgment of this Court dated January 30, 2013, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and judgment of this Court.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
