DECISION & ORDER ON MOTION

In the Matter of Sharon E. Cook, a disbarred

attorney.

Grievance Committee for the Second, Eleventh,

and Thirteenth Judicial Districts, petitioner;

Sharon E. Cook, respondent.

Motion by the respondent, inter alia, in effect, to vacate an opinion and order of this Court dated August 7, 2013, which disbarred her upon her default in answering the petition and struck her name from the roll of attorneys and counselors-at law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Third Judicial Department on January 24, 1984. By decision and order on motion of this Court dated October 19, 2012, inter alia, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against the respondent based on a verified petition dated April 10, 2012, and the issues raised were referred to the Honorable Stella Schindler, as Special Referee, to hear and report.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to vacate the opinion and order dated August 7, 2013, is granted, and the opinion and order of this Court dated August 7, 2013, is recalled and vacated; and it is further,

ORDERED that the respondent, Sharon E. Cook, is reinstated as an attorney and counselor-at-law; and it is further,

ORDERED that the respondent, Sharon E. Cook, shall file an answer to the verified petition dated April 10, 2012, within 10 days of her receipt of a copy of this decision and order on motion; and it is further,

ORDERED that the parties are directed to proceed with the previously authorized disciplinary proceeding; and it is further,

ORDERED that the motion is otherwise denied as academic.
