DECISION & ORDER ON MOTION

Motion by the appellant (1) to recall and vacate so much of a decision and order on motion of this Court, entitled "In the Matter of the Dismissal of Causes for Failure to Perfect - May 2004 Calendar," dated May 24, 2004, as dismissed an appeal from an order of the Supreme Court, Westchester County, dated April 28, 2003, pursuant to 22 NYCRR 670.8(e) for failure to timely perfect, and so much of a decision and order on motion of this Court, entitled "In the Matter of the Dismissal of Causes for Failure to Perfect - October 2004 Calendar," dated November 3, 2004, as dismissed an appeal from an order of the Supreme Court, Westchester County, dated January 30, 2004, pursuant to 22 NYCRR 670.8(e) for failure to timely perfect, (2) to reinstate the appeals, and (3) to stay enforcement of a judgment of the same court entered June 6, 2013, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
