DECISION & ORDER ON MOTION

Motion by the appellant, in effect, for a refund of the filing fee which was paid upon perfection of an appeal from an order and judgment (one paper) of the Supreme Court, Kings County, dated October 2, 2012, and for leave to prosecute the appeal as a poor person. Application by the respondent Katherine A. Levine pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that the application is granted, the time of the respondent Katherine A. Levine to serve and file a brief is enlarged until November 18, 2013, and the brief of the respondent Katherine A. Levine must be served and filed on or before that date.
