| DECISION & ORDER ON MOTION |
Appeal by the plaintiff from an order of the Supreme Court, Kings County, dated February 10, 2012. By decision and order on motion of this Court dated August 19, 2013, the appellant's motion to stay the deposition of Joseph Turkowski was granted on condition that the appeal was perfected on or before September 18, 2013. The appeal has not been perfected.
Now, upon the Court's own motion, it is
ORDERED that the stay granted by the decision and order on motion of this Court dated August 19, 2013, is vacated forthwith.
