Motion by the petitioner in a proceeding pursuant to CPLR article 78 in the nature of mandamus and prohibition for an expedited briefing schedule and a preference in the calendaring of the proceeding. Separate motion by the petitioner, inter alia, pursuant to CPLR 408 for issuance of two subpoenas duces tecum and to "expand[] and/or open[] the certified record of the administrative proceedings."
Upon the papers filed in support of the motion for an expedited briefing schedule and a preference in the calendaring of the proceeding and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion, inter alia, pursuant to CPLR 408 for issuance of two subpoenas duces tecum and the papers filed in opposition thereto, it is
ORDERED that the motions are denied.
