Motion by the appellant for leave to file a supplemental record and replacement brief on an appeal from an order of the Supreme Court, Westchester County, dated September 5, 2012.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the appellant's brief is stricken, and on or before December 2, 2013, the appellant shall serve and file the supplemental record and replacement brief; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until January 2, 2014, and the respondent's brief must be served and filed on or before that date.
