Motion by DLJ Mortgage Capital Inc., to dismiss an appeal from an order of the Supreme Court, Nassau County, entered January 7, 2013, on the ground that no appeal lies from an order denying reargument.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is dismissed on the ground that DLJ Mortgage Capital Inc., is not a party to the appeal; and it is further,
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, for failure to timely perfect (see 22 NYCRR 670.8[e]).
