Motion by the respondents Nanette J. Albanese, Village of Scarsdale, Town of Scarsdale, Board of Assessment Review of Town of Scarsdale, and Assessor of Town of Scarsdale to strike stated portions of the appellant's brief on an appeal from an order of the Supreme Court, Westchester County, dated July 25, 2012, on the ground that the issues raised have been rendered academic.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
