DECISION & ORDER ON MOTION

Motion by Michael J. Connolly counsel assigned to represent the respondent in the Supreme Court, for leave to be relieved of the assignment and to assign another attorney to respond to an appeal by the People from an order of the Supreme Court, Kings County, dated December 10, 2012, and to enlarge the respondent's time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, and Michael J. Connolly, 117-16 Queens Boulevard, Forest Hills, N.Y. 11375, is directed to turn over all papers in the action to new counsel herein assigned; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to defend the appeal:

and it is further,
