DECISION & ORDER ON APPLICATION

Application by the Grievance Committee for the Tenth Judicial District to appoint an attorney pursuant to 22 NYCRR 691.10(g) to inventory the client files of James T. Hytner, a disbarred attorney, which are located at 1 Sargent Court, Saint James, N.Y., and 68 Washington Street, East Setauket, N.Y., and to take such action as seems indicated to protect the interests of said clients.

Mr. Hytner was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on September 26, 1990, under the name James Thomas Hytner. By decision and order on motion of this Court dated April 28, 2009, the respondent was immediately suspended from the practice of law pursuant to 22 NYCRR 691.4(l)(1)(i), based upon his failure to cooperate with the Grievance Committee; the Grievance Committee was authorized to institute and prosecute a disciplinary proceeding against the respondent, based upon a petition dated February 9, 2009; and the matter was referred to Peter T. Affatato, as Special Referee, to hear and report. By opinion and order of this Court dated January 26, 2010, the respondent was disbarred upon his default.

Upon the papers filed in support of the application, it is

ORDERED that Robert P. Guido, Special Counsel for Grievance Matters, 30 East Hoffman Avenue, Lindenhurst, N.Y. 11757-5011, is hereby appointed pursuant to 22 NYCRR 691.10(g) as inventory attorney (1) to take custody of, and inventory, the legal files of James T. Hytner, admitted as James Thomas Hytner, which are located 1 Sargent Court, Saint James, N.Y., and 68 Washington Street, East Setauket, N.Y. (2) to take custody of, and safeguard, the records of any business, escrow, trust, or special account(s) of Mr. Hytner found at the foregoing premises; (3) to receive, open, and read any mail addressed to Mr. Hytner at his regular place of business; and (4) to take such other action as is deemed proper and advisable to protect the interests of Mr. Hytner's former clients in discharging the aforesaid duties.
