| DECISION & ORDER ON MOTION |
Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Nassau County, rendered May 18, 2011, and for the assignment of new counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied without prejudice to the appellant notifying the Court, in writing, on or before December 20, 2013, that he wishes to file a pro se supplemental brief; and whether he needs the transcripts of the proceedings to aid in preparation of the pro se supplemental brief; and it is further,
ORDERED that if the appellant does not notify the Court, in writing, on or before December 20, 2013, as set forth above, the appeal will be proceed on assigned counsel's brief.
