It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that landlord-appellant's motion for a stay of the trial is granted on condition that landlord-
appellant perfects its appeal by no later than the March 2014 term -
the filing deadline is January 8, 2014. In the event of landlord-appellant's failure to comply with the foregoing condition tenant-respondent may move, on five days' notice, for an order dismissing the appeal.
