Respondents-appellants-respondents having moved for an extension of time to perfect the appeal taken herein from an order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Oneida on January 15, 2013, and
Petitioner having cross-moved for an extension of time to perfect the cross appeal taken from the order and judgment entered January 15, 2013,
Now, upon reading and filing the affidavit of Andrew J. Ryan, Esq., sworn to October 21, 2013, the affirmation of Jonathan D. Hitsous, Esq., dated October 23, 2013, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that respondents-appellants-respondents' motion is granted, and respondents-appellants-respondents shall perfect the appeal on or before January 7, 2014, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order, and
It is further ORDERED that petitioner's motion is granted, and petitioner shall perfect the cross appeal on or before February 11, 2014, and, in the event of failure to so perfect, the cross appeal is hereby dismissed without further order.
