On the Court's own motion, it is
ORDERED that the decision and order on application of this Court dated October 9, 2013, in the above-entitled case is recalled and vacated, and the following decision and order on application is substituted therefor:
Application by the appellant pro se to recall and vacate a decision and order on motion of this Court, dated January 26, 2012, which granted his motion for leave to serve and file a supplemental brief on his appeal from a judgment of the County Court, Rockland County, rendered May 4, 2010, and to deem the motion withdrawn.
Upon the papers filed in support of the application, it is
ORDERED that the application is granted, the decision and order on motion of this Court dated January 26, 2012, is recalled and vacated, and the appellant's motion for leave to serve and file a supplemental brief is deemed withdrawn.
