The People of the State of New York, Appellant, v Fernando Garcia, Respondent.

Motion by appellant on an appeal from an order of the Justice Court of the Town of Warwick, Orange County, dated April 5, 2012, to restore the appeal to the general calendar.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the appeal is restored to the general calendar; and it is further,

ORDERED that appellant is directed to serve and file an appellant's brief within 30 days of the date of this decision and order; and it is further,

ORDERED that respondent, if he be so advised, may serve and file a respondent's brief within 21 days after the appellant's brief is due to be served and filed pursuant to this decision and order; and it is further,

ORDERED that appellant, if so advised, may serve and file a reply brief within 14 days after the respondent's brief is due to be served and filed pursuant to this decision and order.
