Motion by respondent on an appeal from an order of the Civil Court of the City of New York, Kings County, entered May 23, 2011, which was determined by decision and order of this court dated March 20, 2013, for the release of funds on deposit.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the funds on deposit are directed to be released to respondent 40-50 Brighton First Road Apartments Corp., less any lawful fees.
