| DECISION & ORDER ON MOTION |
Motion by the appellant pro se, in effect, to strike the respondent's opposition to his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated November 17, 2009 (People v Parks, 67 AD3d 931), affirming a judgment of the Supreme Court, Kings County, rendered June 26, 2006, or, in the alternative, to enlarge the time to serve and file reply to the respondent's opposition.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to strike the respondent's opposition is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file reply to the respondent's opposition is granted, the time to serve and file reply to the respondent's opposition is enlarged until January 21, 2014, and the reply must be served and filed on or before that date.
