DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Rockland County, dated August 22, 2013, in effect, to amend so much of a decision and order on motion of this Court dated September 20, 2013, as conditioned a stay of entry of a judgment upon an arbitration award in favor of the respondent and against the appellant, upon the perfection of the appeal on or before October 21, 2013, and for poor person relief, including waiver of the filing fee and leave to prosecute the appeal on the original papers.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to amend the decision and order on motion dated September 20, 2013, is granted, and the decision and order on motion dated September 20, 2013, is amended by deleting from the decretal paragraphs thereof the date "October 21, 2013," and substituting therefor the date "December 23, 2013"; and it is further,

ORDERED that the motion is otherwise denied.
