| DECISION & ORDER ON MOTION |
Motion by the appellants-respondents to enlarge the time to perfect an appeal and cross appeals from an order of the Supreme Court, Queens County, entered October 15, 2012. Application by the defendant-respondent-appellant pursuant to 22 NYCRR 670.8(d)(2) for the same relief.
Upon the papers filed in support of the motion and the application, and the papers filed in opposition thereto, it is
ORDERED that the motion and the application are granted; and it is further,
ORDERED that the time to perfect the appeal is enlarged until January 24, 2014, and the joint record or appendix on the appeal (see 22 NYCRR 670.8[c][1]) and the appellants-respondents' brief must be served and filed on or before that date; and it is further,
ORDERED that the defendants third-party/second third-party plaintiffs-respondents-appellants and the defendant-respondent-appellant shall serve and file their respective answering briefs, including the points of argument on the cross appeals, in accordance with the rules of this Court (see 22 NYCRR 670.8[c][3]).
