DECISION & ORDER ON MOTION

Motion by Gerard Amalfitano, as court-appointed inventory attorney for the files of suspended attorney Andrew H. DePodwin (1) to be discharged in the above-captioned matter, and (2) to authorize the destruction of any remaining files contemplated by the court-ordered inventory that remain unclaimed. By decision and order on motion dated March 29, 2010, the Court appointed Gerard Amalfitano, as inventory attorney with respect to the files of Andrew H. DePodwin, a suspended attorney.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and Gerard Amalfitano is relieved of the appointment as inventory attorney; and it is further,

ORDERED that Gerard Amalfitano is authorized to destroy by incineration or shredding, any remaining files contemplated by the court-ordered inventory that remain unclaimed; and it is further,

ORDERED that Gerard Amalfitano shall provide the Grievance Committee for the Tenth Judicial District with a record of all files inventoried, and whether those files were delivered to clients or their counsel, or remained unclaimed and were destroyed; and it is further,

ORDERED that Gerard Amalfitano shall turn over to the Grievance Committee any and all bank and bookkeeping records of Andrew H. DePodwin, for safekeeping.
