| DECISION & ORDER ON MOTION |
Motion by the respondents to dismiss an appeal from a judgment of the Supreme Court, Nassau County, dated March 11, 2013, for failure to settle and file the trial transcript, or to direct the appellant to settle and file the trial transcript, and to enlarge the time to file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to direct the appellant to settle and file the trial transcript is granted, and on or before February 3, 2014, the appellant shall settle the transcript and file the settled transcript in the office of the Clerk of this Court; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondents' time to serve and file a brief is enlarged until March 5, 2014, and the respondents' brief must be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
