Motion by the appellant-respondent for leave to reargue stated portions of an appeal and cross appeal from a judgment of the Supreme Court, Nassau County, entered July 12, 2012, which were determined by decision and order of this Court dated September 11, 2013, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
