DECISION & ORDER ON MOTION

Appeal by Edward Koehl from a judgment of the Supreme Court, Dutchess County, dated April 3, 2013.

On the Court's own motion, it is

ORDERED that the appeal in the above-entitled matter and the appellant's pending motion are transferred to the Appellate Division, First Department, pursuant to New York Constitution, article VI, § 4(i), for hearing and determination; and it is further,

ORDERED that all further proceedings in connection with this appeal shall be conducted pursuant to the rules of the Appellate Division, First Department.
