| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by Peter T. Sylver for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Sylver was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on May 18,1998, under the name Peter Timothy Sylver. By decision and order on motion of this Court dated August 30, 2005, Mr. Sylver was suspended from the practice of law as a result of his conviction of a serious crime pursuant to Judiciary Law § 90(4)(f), the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against him, and the issues raised were referred to the Honorable John A. Monteleone, as Special Referee, to hear and report. By opinion and order of this Court dated August 29, 2006, Mr. Sylver was suspended from the practice of law for a period of two years, with credit for the time elapsed under the interim suspension imposed by the decision and order on motion dated August 30, 2005. By decision and order on motion of this Court dated October 17, 2008, Mr. Sylver's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on Mr. Sylver's current fitness to practice law, including but not limited to, Mr. Sylver's past employment as a staff attorney with the Massachusetts Justice Project, and to inquire whether he was admitted to the Bar in the State of Massachusetts.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is
ORDERED that the motion is denied.
We find that Peter T. Sylver does not demonstrate the requisite fitness and character to practice law.
