Motion by respondent on an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered January 24, 2013, to vacate a stay granted by decision and order of this court dated May 13, 2013, to dismiss the appeal and for the release of funds on deposit.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the respondent's motion is granted and the appeal is dismissed and the stay is vacated; and it is further,
ORDERED that the branch of the motion seeking the release of funds on deposit is likewise granted.
