DECISION & ORDER ON MOTION

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered July 1, 2013, as a poor person, and for the assignment of counsel. By order to show cause dated October 15, 2013, appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as untimely and appellant had not sought leave to file a late notice of appeal (see CPL 460.10, 460.30), and the motion by appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel was held in abeyance in the interim.
Upon the order to show cause and no papers having been filed in response thereto, and upon the papers filed in support of the motion by appellant and no papers having been filed in relation thereto, it is
ORDERED that the appeal is dismissed as untimely (see CPL 460.10 [1] [a]); and it is further,
ORDERED that appellant's motion is denied as academic.
