Motion by the appellant for leave to reargue appeals from an order of the Supreme Court, Nassau County, dated October 2, 2012, and a judgment of the same court dated December 20, 2012,, which were determined by decision and order of this Court dated October 16, 2013, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
