On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated December 19, 2013, in the above-entitled matter, on an appeal from a judgment of the Supreme Court, Queens County, rendered April 21, 2009, is amended by deleting from the second paragraph thereof the words "no papers having been filed in opposition or," and substituting therefor the words "the papers filed."
