| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated April 26, 1999 (People v Xao He Lu, 260 AD2d 997), affirming a sentence of the Supreme Court, Kings County, imposed October 25, 1996. The application was determined by decision and order of this Court dated May 22, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
