| DECISION & ORDER ON MOTION |
Motion by the appellant pursuant to CPLR 5520 to deem a notice of appeal from an order of the Supreme Court, Suffolk County, dated April 2, 2012, to be a premature notice of appeal from a judgment of the same court entered May 20, 2013, and to limit the issues raised on the appeal from the judgment to be the issues raised in the brief filed in connection with the appeal from the order.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before February 5, 2014, the appellant shall serve and file a supplemental record containing the judgment entered May 20, 2013.
