| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, in effect, to recall and vacate so much of a decision and order on motion of this Court dated October 7, 2013, as dismissed an appeal from an order of the Supreme Court, Queens County, dated February 1, 2013, on the ground that the appellant is not aggrieved, to reinstate the appeal, to enlarge the time to perfect the appeal, and for poor person relief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to recall and vacate so much of the decision and order on motion of this Court dated October 7, 2013, as dismissed the appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
