DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from of an order of the Supreme Court, Suffolk County, dated September 10, 2013, inter alia, in effect, to deny the appellant's motion for poor person relief and to impose a sanction upon the appellant and the appellant's the appellant's motion for counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is, in effect, to deny the appellant's motion for poor person relief is denied as academic in light of the decision and order on motion of this Court dated November 15, 2013; and it is further,

ORDERED that the motion is otherwise denied.
